The status of transgender persons in civil law

The status of transgender persons in civil law Abstract The thesis focuses on the legal regulation of gender reassignment in the Czech Republic, both in terms of civil law and constitutional law. The thesis initially focuses mainly on the correct definition of important terms and their essential meaning. Attention is paid not only to transsexuality itself and its forms, but also to related conditions such as intersexuality and transvestitism. After discussing the human rights foundations of gender reassignment, the thesis briefly discusses the historical genesis of the legal regulation of gender reassignment. This is followed by a description of the currently effective legislation, including its shortcomings with regard not only to domestic law but also to the Czech Republic's international obligations under international human rights treaties. In this area, the greatest emphasis is then placed on the decision-making of the European Court of Human Rights, which is more advanced than Czech national courts in this area. Transsexuality (ethical aspects of gender transitioning and role of social work in the process)

This thesis deals with the transgender phenomenon and in three chapters explores the ethical level of transitioning and the specifics of social work with transgender clientele. First chapter presents general insight into the topic and looks into the terminological difference between the terms gender and sex, transgender and transsexuality. After that it deals with aspects of the process of transition and also briefly describes the etiology of transgender identity, representation of trans individuals in the population and the phenomenon of minority stress. Second chapter of the thesis introduces the results of a research realised as a part of the work. The results are compiled into narrations of the participants transgender life stories. Third chapter sums up the ethical dilemmas related to the transitioning process, selected ethical dilemma taken from realised research is reflected through the optics of two ethical stances (deontology of I. Kant and utilitarianism of J. S. Mill). Closing part is designated for dealing with the specifics of social work with transgender clients and are presented competences needed for high-quality social work with the transgender target group.
Transition as a way to self-acceptance

This bachelor thesis deals with the issue of transition, in the social, medical, and legal spheres. It explores the lives of trans people from their first awareness of their gender identity, through coming out, hormone therapy and gender-affirming surgery. It traces the critical moments of transition and complications that arise during it. It also explores socially conditioned attitudes and negative social reception. The empirical part is developed using a qualitative strategy, in-depth interviews with people who have gone through the process of transition. It explores how trans people experience their transition, how the decision to transition is made, their satisfaction with their transition, and more. It also focuses on the reaction of the close people and surroundings and the subsequent impact on the trans person.
Transsexualism - how a parent and his child experience his or her gender reassingment

This bachelor's thesis focus on the experience of children whose parents have gone through or are going through the process of gender reassignment and at the same time focuses on the parents themselves who have undergone or are undergoing the process of gender reassignment. The aim of the work was to map how children experience the gender reassignment of parents, especially how they feel about this situation, whether the relationship between the child and the parent has changed and also what difficulties they face due to the change of parents. A partial goal was also to find out what assumptions of transgender parents themselves about the experience of their children in relation to their transition. Data collection was performed using semi-structured interviews. These data were then analyzed using content analysis and processed in the form of case studies. The results show that most children did not experience their parent´s sex change negatively. However, they faced a number of difficulties, which greatly affected their experience.
Social Work and Transgender People

This thesis explores the topic of transgender people as clients of social work. Its goal is to examine transgender experiences in the context of Czech social work. The first part is theoretical and focuses on terminology and current situation, mentioning legal framework and possible developements. The theoretical part includes a list of LGBT+ organisations which provide diverse kinds of support to transgender people. I chose qualitative approach for exploring this topic and conducted narrative interviews. For this purpose I contacted transgender people who had the experience of being clients of social services. I analysed the outputs by the open coding method inspired by the Grounded Theory. Based on the comparison between the interviews and expert advice I found out the following: the basic need among transgender clients of social work is for their experienced gender identity to be recognised and respected. It is also important for the quality of their mutual interaction that the social worker is aware of transgender issues. However, based on the collected transgender experiences, those needs are not always met. The level of knowledge on this topic and their stance varies among social workers in the Czech Republic. Finally, this thesis poses a question, whether social services providing accomodation might potentially expose transgender clients to more confrontational situations where gender is an improtant factor. Yet, it is concluded that the overall approach of the service matters the most. The results of this work will be presented to the FOKUS České Budějovice NGO employees.

Transsexuality in law Abstract Gender reassignment is a topical issue that concerns only a relatively small number of people and is not given the necessary attention in the Czech legal environment, although the legislation is insufficient for a long time and does not comply with internationally recognized human rights standards. The legal system is based on the binary concept of gender and trans people are often unable to place themselves within it. The title of the thesis reflects the legal situation of trans people in the Czech Republic, as the legislation pays attention only to transsexuals and allows them to achieve life in the official gender they identify as. The law forgets other trans people who, for various reasons, do not wish to undergo surgical gender reassignment and, due to unfavorable legislation, have to deal with unpleasant and humiliating situations and discrimination. The thesis provides an explanation of the terminology of the issue, a description of the process of gender reassignment and an analysis of the legal status of transgender people in the Czech Republic with an emphasis on a critical analysis of key aspects of gender reassignment. Literary work of transgenders at community websites

Bachelor thesis deals with the literary work of people diagnosed with transsexuality, specifically texts that are published on the website for transsexuals, their families and closest friends. The aim of my study was to determine what these contributions reveal, and what the predominant theme in them, trying to map the subjective experience of the individual authors and I have also focused on the responses of readers, who, under various texts can contribute their comments. In analyzing the texts I used content analysis to determine the form, content and theme of each cell and in addition to this I used the narrative analysis, in which I determined the narrative category focused on the topic, the way the topic tell to whom the text is addressed to and what events it writing prior to and at the end, as the text was accepted by readers who visit the community website. Psychological aspects of the transformation of gender role of transgenders in Czech context

The thesis presents the processes of gender role transition and sex reassignment from the perspectives of psychology, medicine, and sociology. Its main focus is on the various aspects influencing the psyche of a person undertaking transition. The thesis investigates why trans identity is commonly viewed as a pathology and the impact of pathologization on the self-perception of trans people. Furthemore, the traditional outline of the transition process in Czech sexology is compared to some current international approaches. A section of the text addresses psychotherapy as a key factor in transition. A significant component of the thesis is that it takes a sociocultural viewpoint on gender identity and gender roles. One of the goals is to understand how medical experts dealing with trans identity conceptualize transition and how trans people themselves conceptualize it. The overall aim is to investigate how both of these sides influence each other and what psychological aspects enter the processes of gender role transition and sex reassignment. Transgender identity

The main purpose of the present diploma thesis is to introduce the transgender identity as a newly emerging lifestyle and political activism of transpeople. Because the transgenderism has been formed in opposition to the dominant medical discourse of transsexuality, it is necessary to include the transsexual stand of view which transgender people are defining against. I regard the transsexuality and transgenderism as two different discourses forming new different identity categories, having specific impact on lives of people they are naming. I focus mainly on the impact of different concepts of sex, gender and sexuality on formation of specific shapes of these ideologies. In the empirical part, I am applying my mind on the narrative construction of transgender identity. Through some parts of interview with a person diagnosed with transsexuality, that has accepted the identity of a transgender in the course of his life, I try to mediate a more realistic and sculpturesque image of transgender/transsexual life, identity and sense of self.
Gay pride: the media portrait of homosexuality in czech media based on the example of gay marches

This thesis describes the reflection of homosexuality in Czech media on the example of marches of homosexuals. Firstly I clarify the main terms and the differences between them, then I focus on the history of perception of homosexuality and the roles of homosexuals in our society. The chosen units for the content analysis are following periodicals: MF Dnes, Právo and Lidové noviny. The analysis focuses on the articles published in the range of three months from the day the events took place during the years 2008 and 2011. In the analytical part of this thesis I firstly characterize the marches held twice in Brno, once in Tábor and once in Prague. All the periodicals were interested in the first Queer Parade in Brno but their interest in the second and third one dropped. The most media attention achieved the Prague Pride in 2011. There have been over 100 articles about this topic and their size rose and dropped equally with the number of visitors of these events. The interest of the media has also been influenced by any kind of negative event, mainly when the marches were attacked by extremists or criticised by politicians.
